Terms of Service for CatchFrase

Please read these Terms of Service ("Terms") carefully before using CatchFrase ("the App") operated by Alex Yao ("we," "our," or "us").

By downloading, installing, or using CatchFrase, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using CatchFrase, you confirm that you are at least 13 years old and that you accept these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use CatchFrase for your personal, non-commercial use on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

CatchFrase lets you capture photos of objects to generate vocabulary cards. You retain ownership of the photos you capture. By using the feature, you grant us and our service providers a limited license to process your photo solely to identify the object and generate a card, as described in the Privacy Policy. Photos and cards are stored on your device.

5. Third-Party Services

The App relies on third-party services to identify objects, generate content, recognize speech, manage subscriptions, and report crashes: Google (Gemini API), Cloudflare (Workers), fal (segmentation), Apple (Speech Recognition), RevenueCat (subscription status), and Sentry (crash reports). What each one receives is set out in Section 4 of our Privacy Policy. Your use of those features is also subject to those providers' terms and policies. We are not responsible for third-party services.

6. No Accounts; Subscriptions and Billing

CatchFrase does not require an account. There is no login, and you can use the free tier without giving us any personal details.

The App is free to download and use. It also offers an optional auto-renewing subscription, CatchFrase Plus, which unlocks unlimited catches and collection, phrase variants, generated mini-dialogues, pronunciation practice, review scheduling, and all nine languages.

Plans and price. Plus is sold in two plans: US$59.99 per year, or US$9.99 per month. Prices are shown in US dollars; the price in your country is set by the App Store and may differ. New subscribers to the yearly plan receive a seven-day free trial. The monthly plan has no trial and bills immediately.

Billing and renewal. Purchases are processed by Apple and charged to your Apple Account. A subscription renews automatically at the end of each period unless you cancel at least 24 hours before that period ends, and your Apple Account is charged for renewal within 24 hours of the period ending. If you take the free trial and do not cancel before it ends, the subscription begins and the first year is charged.

Managing and cancelling. Manage or cancel your subscription in the Apple Account settings on your device. Deleting the App does not cancel a subscription. Any unused part of a free trial is forfeited when you buy a subscription.

Refunds. Apple handles all purchases and refunds for the App. Refund requests go to Apple, not to us.

7. Intellectual Property

The App, including its design, text, graphics, and software, is owned by Alex Yao and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that the language content it generates will be accurate or complete. Generated translations, pronunciations, and example sentences are produced by AI and may contain errors; do not rely on them for critical purposes.

9. Limitation of Liability

To the maximum extent permitted by law, Alex Yao shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App. Our total liability for any claim related to the App shall not exceed the greater of the amount you paid for the App (if any) or US$10.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

12. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will update the "Last Updated" date above. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
